The Clear Escape: Las Vegas Fly Away Sweepstakes Terms and Conditions
1. Eligibility:
– Open to legal residents of Montana, aged 21 or older at the time of entry.
– Must be signed up for Bloom Rewards to Enter.
– Employees of Bloom and The Clear, their affiliates, subsidiaries, advertising and promotion agencies, and immediate family members are not eligible to participate.
2. Sweepstakes Period:
– The Sweepstakes begins on 8/1/24 and ends on 9/12/24.
3. How to Enter:
– Purchase any Clear or Twax product at Bloom, Sweetgrass or Fat Hippie during the Sweepstakes Period to receive one entry into the drawing.
4. Prize:
– One (1) Grand Prize winner will receive:
– Roundtrip airfare for two (2) from Billings, Bozeman or Missoula to Las Vegas, NV.
– Hotel accommodations for two (2) on the Las Vegas Strip (standard double occupancy room) for 2 nights.
– Two (2) tickets to the Sphere in Las Vegas.
– The approximate retail value of the Grand Prize Is $2,000. The prize is non-transferable and no substitution will be made except as provided herein at the Sponsor’s sole discretion.
5. Winner Selection and Notification:
– The winner will be selected in a random drawing from all eligible entries received during the Sweepstakes Period.
– The drawing will be held on 09/20/24.
– The winner will be notified via email and/or phone within 7 (Seven) days following the drawing. If the winner cannot be contacted, is ineligible, does not complete and return an executed declaration and release within the specified timeframe, or fails to claim the prize within 7 (Seven) days from the time the award notification was sent, the prize may be forfeited, and an alternate winner will be selected.
6. General Conditions:
– Prize cost is non-transferable.
– The Sponsor reserves the right to cancel, suspend, and/or modify the Sweepstakes if any fraud, technical failures, human error, or any other factor impairs the integrity or proper functioning of the Sweepstakes, as determined by the Sponsor in its sole discretion.
– The Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of these Terms and Conditions or any other promotion or in an unsportsmanlike or disruptive manner.
7. Release and Limitations of Liability:
– By participating in the Sweepstakes, entrants agree to release and hold harmless the Sponsor, Bloom, and their respective subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies, and prize suppliers, and each of their respective parent companies and each such company’s officers, directors, employees, and agents (collectively, the “Released Parties”) from and against any claim or cause of action arising out of participation in the Sweepstakes or receipt or use of any prize, including, but not limited to: (a) unauthorized human intervention in the Sweepstakes; (b) technical errors related to computers, servers, providers, or telephone or network lines; (c) printing errors; (d) lost, late, postage-due, misdirected, or undeliverable mail; (e) errors in the administration of the Sweepstakes or the processing of entries; or (f) injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Sweepstakes or receipt or use or misuse of any prize.
8. Disputes:
– Except where prohibited, entrant agrees that: (a) any and all disputes, claims, and causes of action arising out of or connected with this Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in [Your State]; (b) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorneys’ fees; and (c) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental, and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.
